Teck Trail Smelter Superfund decision blow for Canadian/U.S. mining companies

A federal judge has ruled that U.S. Superfund law makes Canadian miner Teck Resources liable for cleaning up smelter slag contamination of the Upper Columbia River in Washington State.

RENO (MINEWEB) - A decision last week by a U.S. federal district court judge ruling that Canadian mining company Teck Resources is subject to the jurisdiction of the U.S. Superfund law regarding the cleanup of the upper Columbia River in Washington State may set a legal precedent for pollution generated by Canadian mining operations, which eventually pollute U.S. waters.
In a decision announced late Friday, U.S. District Judge Lonny R. Suko issued a declaratory judgment that Teck Metals is liable under CERCLA (commonly known as the “Superfund Law”) for the costs (to be determined by a subsequent hearing scheduled later this year) for natural resource damages and costs associated with cleaning up the Upper Columbia River in and around Lake Roosevelt.

A federal judge Friday found a Canadian smelter responsible for the millions of tons of pollutants it dumped into the Columbia River. Reporting for EarthFix, Courtney Flatt has more.
For nearly 100 years, smelter Teck Metals dumped pollutants into the Columbia River, less than 10 miles upstream from the U.S.-Canada border.
Over the years, close to 10 million tons of waste poured into the river. The waste, also called slag and slurry, contained mercury and other toxics.
The Colville Confederated Tribes and the state of Washington sued the mining company. A U.S. District Court judge has found that Teck Metals is liable for the pollution.
Canada objected. Its lawyers said the lawsuit infringed on Canadian sovereignty.
A second trial phase will decide how much the company has to pay for its history of pollution.
